1. Definitions
- Redmist: Refers to the online store operated by Foretexmark OU, an Estonian company registered under the laws of Estonia. Foretexmark OU specializes in the trading of virtual in-game items, commonly known as "skins," for popular video games such as TF2, CS:GO, and DOTA2.
- User: Any individual who accesses, browses, or uses the Redmist online store, either as a visitor or a registered member.
- Skins: Virtual in-game items or cosmetics that can be used within the specified video games. These skins may include but are not limited to weapons, character outfits, and other customizable items.
- EULAs: End User License Agreements that are specific to the video games for which skins are traded on the Redmist online store. EULAs outline the terms and conditions under which users are permitted to use the video games and associated content.
2. Eligibility
Users must be at least 18 years old or the legal age of majority in their jurisdiction to access or use the Redmist online store. By accessing or using the store, users represent and warrant that they meet the eligibility requirements and are legally permitted to enter into binding contracts.
3. Restrictions
Users are strictly prohibited from:
- Using the Redmist online store for any illegal, fraudulent, or unauthorized purpose, including but not limited to money laundering, fraud, or any other criminal activity.
- Misrepresenting any personal or payment information provided to Foretexmark OU, including using false identities or unauthorized payment methods.
- Interfering with or disrupting the operation of the Redmist online store, including but not limited to introducing viruses, trojans, worms, or other harmful code, or engaging in denial-of-service attacks.
- Violating any EULAs, terms of service, or other agreements associated with the video games or platforms for which skins are traded on the Redmist online store, including engaging in unauthorized trading, selling, or transferring of skins.
4. Orders and Payments
- All orders placed through the Redmist online store are subject to availability and acceptance by Foretexmark OU. Upon placing an order, users will receive an order confirmation via email, which serves as acceptance of the order.
- Prices for skins are displayed in the currency specified on the Redmist online store and are subject to change without prior notice. All prices are inclusive of applicable taxes, unless otherwise stated.
- Payments must be made in full at the time of purchase using the payment methods accepted by Foretexmark OU, which include your balance (toped up by your credit/debit card).
- Once payment is received and verified, the purchased skins will be delivered to the user's account on the respective video game platform within the timeframe specified on the Redmist online store.
- Refunds or exchanges for purchased skins are generally not permitted, except as required by law or as otherwise specified in these Terms of Use.
5. Gift Cards
- Gift cards purchased from Redmist online store are non-refundable and can not be exchanged for cash or other gift cards.
- Gift cards are valid for the period specified on the card or as required by law. Expired gift cards cannot be redeemed or extended.
- Foretexmark OU is not responsible for lost, stolen, or unauthorized use of gift cards. Users are advised to treat gift cards like cash and keep them in a safe place.
6. Changes to the Terms of Use
Foretexmark OU reserves the right to modify or update these Terms of Use at any time without prior notice. Any changes will be posted on the Redmist online store, and it is the user's responsibility to review the Terms of Use periodically for updates. Continued use of the Redmist online store after the posting of changes constitutes acceptance of the updated Terms of Use.
7. Limitation of Liability
Foretexmark OU shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Redmist online store, including but not limited to:
- Loss of profits, revenue, data, or other intangible losses.
- Any unauthorized access to or use of the Redmist online store or servers.
- Any bugs, viruses, or other harmful code that may be transmitted through the Redmist online store by third parties.
- Any errors, inaccuracies, or omissions in the content or information provided on the Redmist online store.
8. Indemnifications
Users agree to indemnify, defend, and hold harmless Foretexmark OU, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, or expenses (including legal fees) arising out of or in any way connected with:
- The user's breach of these Terms of Use or any other agreements or policies referenced herein.
- The user's violation of any third-party rights, including but not limited to intellectual property rights or privacy rights.
- Any use or misuse of the Redmist online store by the user or any third party acting on the user's behalf.
9. EULAs
Users acknowledge and agree that the purchase, trade, and use of skins are subject to the EULAs of the respective video games. Users are responsible for reading, understanding, and complying with the terms and conditions set forth in the EULAs, which may include restrictions on trading, selling, or transferring skins.
10. Intellectual Property
All content, including but not limited to logos, graphics, images, text, and software, displayed on the Redmist online store is the property of Foretexmark OU or its licensors and is protected by copyright, trademark, patent, and other intellectual property laws. Users are strictly prohibited from:
- Reproducing, distributing, or publicly displaying any content from the Redmist online store without prior written (by email) consent from Foretexmark OU.
- Modifying, adapting, or creating derivative works based on any content from the Redmist online store.
- Using any trademarks, logos, or other proprietary information of Foretexmark OU without express written (by email) permission.
11. Miscellaneous
- These Terms of Use constitute the entire agreement between the user and Foretexmark OU regarding the use of the Redmist online store and supersede any prior agreements or understandings, whether oral or written (by email).
- If any provision of these Terms of Use is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary so that these Terms of Use shall otherwise remain in full force and effect.
- The failure of Foretexmark OU to enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.
12. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the courts of Estonia.
